Jurisdiction

Jurisdiction is a concept over the interpretation of which many scholars ponder, and so far they have not come to a consensus. Many identify the concept of “jurisdiction” and “competence”.

In general terms, jurisdiction is an established by law powers of state bodies to resolve various legal disputes, solve cases related to offenses, as well as assess the legality of the actions of individuals and legal entities.

Different disputable situations regularly arise in life. To resolve them, the state has given various state bodies certain powers and delineated their duties. For example, the Ministry of Internal Affairs is engaged in operational and investigative activities, the investigative authorities investigate criminal cases, and the courts prosecute the guilty persons.

The main features of jurisdiction:

  • For each state body it is fixed at the legislative level. Each structure is governed by its own regulations;
  • applies only to the state bodies;
  • provides for the possibility of the state structure to make decisions independently and on the basis of these decisions to issue relevant documents: acts, rulings, decisions, etc.

administrative jurisdiction. Various legal issues are resolved by the executive authorities. For example, the city administration plans the local budget, implements various socio-economic programs aimed at the development of the city or district. Juveniles are dealt with by a special commission, which may issue relevant documents and issue fines for offenses committed by children;
Judicial jurisdiction. These are different types of disputes, which are considered only by the court of a certain instance. There is some distinction between courts of general jurisdiction and specialized courts (depending on the structure of state and law enforcement agencies in the country).

Jurisdiction, in turn, is divided into two concepts:

  • jurisdiction – that is, the subject matter of the dispute is to be considered only in court, and not by another body of state power;
  • Jurisdiction – determines which court will consider the dispute, here the concept of territorial jurisdiction may also be involved.

Simply put, jurisdiction is certain powers of a particular state body, which allow it to make decisions independently, but within the limits strictly defined by legislation and normative legal acts.
